Mengawal Integritas Pemilu 2024
ATMOSFER politik Tanah Air mulai menghangat menyusul penetapan 17 partai politik nasional dan 6 partai politik lokal Aceh sebagai peserta Pemilu 2024 melalui Keputusan Komisi Pemilihan Umum (KPU) Nomor 518 Tahun 2022.
Tahapan penetapan peserta pemilu itu menjadi semacam penanda sesungguhnya dimulainya pesta demokrasi yang akan menentukan hitam putih sejarah kita ke depan sebagai bangsa yang menganut doktrin negara hukum yang demokratis. Ini merupakan salah satu tahapan yang lebih menarik perhatian khalayak ketimbang tahapan sebelumnya seperti perencanaan program dan anggaran, penyusunan peraturan KPU, pemutakhiran data pemilih dan penyusunan daftar pemilih, serta pendaftaran dan verifikasi peserta pemilu.
Sayangnya, ingar bingar penetapan peserta pemilu itu sempat diwarnai kabar tak sedap. Media Indonesia (14/12/2022) mewartakan adanya dugaan kecurangan dengan memanipulasi dan mengubah data partai politik dalam Sistem Informasi Partai Politik (Sipol). Kecurangan itu berujung pada berubahnya status tidak memenuhi syarat (TMS) menjadi memenuhi syarat (MS) untuk sejumlah partai politik dalam tahapan verifikasi faktual.
Seperti diketahui, verifikasi faktual ialah tahapan penelitian atau pemeriksaan syarat kepengurusan dan keanggotaan partai politik yang dikhususkan bagi partai politik yang tidak memiliki kursi di DPR RI karena gagal memenuhi ambang batas parlemen (parliamentary threshold) sedikitnya 4% dan partai politik baru. Lebih mengkhawatirkan lagi, dugaan kecurangan itu disinyalir terjadi karena intervensi dan intimidasi dari pejabat KPU, baik di pusat maupun provinsi.
Bila sinyalemen itu faktual adanya, sungguh patut disayangkan. Betapa tidak? Pemilu yang baru saja memasuki tahapan awal sudah dinodai dengan dugaan penyelewengan, yang tentu saja menjadi pukulan berat bagi kehidupan demokrasi kita, yang kini mengalami regresi. Apalagi, saat ini kita telah dan sedang menyaksikan merapuhnya institusi-institusi demokrasi. Sebut saja Mahkamah Konstitusi (MK), Mahkamah Agung (MA), dan Komisi Pemberantasan Korupsi (KPK). Kita berharap, KPU tidak menjadi pengisi daftar berikutnya.
Bagaimanapun juga, dugaan kecurangan yang berujung pada distorsi objektivitas verifikasi faktual untuk meloloskan sejumlah partai politik tertentu dapat merusak integritas pemilu. Hal itu merupakan imbas dari delegitimasi penyelenggara pemilu yang tidak memperlihatkan kinerja seperti yang diharapkan. Tidak hanya itu, untuk saat ini situasi keruh akibat dugaan kecurangan patut dikhawatirkan dapat dimanfaatkan sebagai instrumen justifikasi oleh pihak-pihak tertentu yang masih saja mewacanakan penundaan pemilu.
Inti demokrasi
Pemilu menjadi jangkar keabsahan penerapan demokrasi di suatu negara. Melalui pemilu, rakyat memiliki mekanisme secara berdaulat untuk memilih, mempertahankan, atau mengganti pemimpinnya secara bebas, hal yang tak dapat ditemukan dalam sistem politik nondemokratis. Pemilu ialah sarana persaingan perebutan jabatan-jabatan politik dan transfer kekuasaan secara damai. Jika dulu kekuasaan diperebutkan dalam kancah pertempuran atau peperangan yang berdarah-darah, kini kekuasaan diperebutkan dalam pemilu untuk memikat suara rakyat melalui visi, misi, dan program yang ditawarkan.
Oleh karena itu, pemilu sering kali dideskripsikan sebagai inti demokrasi yang menjadi sarana utama bagi individu untuk berpartisipasi dalam urusan publik. Partisipasi rakyat dalam urusan publik melalui pemilu merupakan HAM yang dilindungi instrumen hukum HAM internasional.
Dengan fungsi sekrusial itu, pemilu wajib dikawal integritasnya. Dari sini muncullah istilah integritas pemilu (electoral integrity). Hingga kini, memang belum ada definisi integritas pemilu yang disepakati secara universal. Akan tetapi, Pippa Norris dalam Why Electoral Integrity Matters (2014) menyatakan integritas pemilu mengacu pada standar internasional dan norma global yang mengatur penyelenggaraan pemilu yang tepat.
Pendapat lain menyebutkan secara umum integritas pemilu dapat didefinisikan sebagai setiap pemilu yang didasarkan pada prinsip-prinsip demokrasi hak pilih yang bersifat universal dan persamaan politik sebagaimana tecermin dalam standar dan kesepakatan internasional, profesional, tidak memihak, serta transparan dalam persiapan dan administrasinya sepanjang siklus pemilu (Kofi Annan Foundation, 2012).
Integritas pemilu dapat diukur dengan melakukan analisis atas keandalan regulasi, tahapan, pembentukan daerah pemilihan, daftar pemilih tetap, pendaftaran partai politik peserta pemilu, pencalonan kandidat, pemberitaan media. Juga, dana kampanye, pemungutan suara, penghitungan suara, rekapitulasi suara, penyelenggara pemilu, peserta pemilu, dan tentunya masyarakat pemilih.
Meskipun demikian, dalam praktiknya subjek yang menjadi penentu suatu pemilu berintegritas atau tidak berintegritas lebih banyak ditagihkan kepada penyelenggara pemilu. Dalam konteks Indonesia ada KPU, Bawaslu, dan DKPP. Karena itu, dugaan kecurangan yang melibatkan penyelenggara pemilu, jika tidak ditangani secara serius, dapat merusak bangunan pemilu berintegritas yang pada urutannya akan membuat kepercayaan publik terhadap hasil pemilu menyusut.
Antitesis dari integritas pemilu ialah malapraktik pemilu (electoral malpractice), yang secara umum dipahami sebagai tindakan ilegal atau tidak bertanggung jawab yang dilakukan penyelenggara pemilu, partai politik, kandidat, atau pemilih yang dapat memengaruhi kelancaran pemilu di suatu negara. Dengan asumsi dugaan kecurangan tersebut benar, ia dapat dikualifikasikan sebagai malapraktik pemilu.
Hal yang harus segera dilakukan para pemangku kepentingan di bidang kepemiluan ialah memastikan penanganan dan penyelesaian dugaan kecurangan yang merupakan malapraktik pemilu itu sesuai dengan koridor hukum yang tersedia. Koridor hukum itu dapat meliputi bidang sengketa proses pemilu yang akan diselesaikan Bawaslu. Pelanggaran kode etik penyelenggara pemilu menjadi tanggung jawab DKPP.
Terakhir, jika ada indikasi tindak pidana dalam dugaan kecurangan itu, hal itu menjadi wewenang kepolisian untuk menanganinya.
Pada akhirnya, perlu ditegaskan bahwa kadang kala pemilu yang baik tidak selalu pemilu yang tanpa cacat dengan nihil pelanggaran, tetapi pemilu yang ketika pelanggaran terjadi di dalamnya dapat diselesaikan melalui koridor hukum sebaik-baiknya.
