Dekan Fakultas Hukum Universitas Pembangunan Nasional “Veteran” Jakarta (UPN”V”J), Abdul Halim meminta Komisi Pemberantasan Korupsi (KPK) memeriksa Perguruan Tinggi yang terindikasi melakukan korupsi penerimaan mahasiswa baru jalur mandiri untuk menyelamatkan dunia pendidikan.
“Perguruan Tinggi Negeri (PTN) harus ambil bagian dalam proses pemberantasan Korupsi di Indonesia dengan bekerjasama dengan lembaga penegakan hukum di Indonesia. Masyarakat Kampus dan Perguruan Tinggi harus proaktif menjadi bagian pemberantasan korupsi. Minimal membersihkan lingkungan kampusnya masing-masing dan memastikan PTN terbebas dari praktik kotor yang merugikan masyarakat,” Demikian disampaikan Abdul Halim Dekan FH UPN “Veteran” Jakarta ketika diminta pendapatnya seputar diperiksanya beberapa PTN oleh Komisi Pemberantasan Korupsi (KPK) akhir-akhir ini di Jakarta (12/10/2022).
Seperti diketahui, Tim KPK telah melakukan penelusuran hasil dari pengembangan Operasi Tangkap Tangan (OTT) atas dugaan tindak pidana suap dalam proses penerimaan mahasiswa baru yang diduga melibatkan Rektor Universitas Negeri Lampung (Unila), Prof. Dr. Karomani, M.Si pada 19 Agustus 2022 lalu bersama tujuh orang lainnya. Terbaru, KPK menggeledah Gedung Universitas Sultan Agung Tirtayasa (Untirta), Universitas Riau (Unri) hingga Universitas Syiah Kuala (USK) Aceh. “Semoga tidak ada lagi PTN yang bernasib serupa,” harap Halim.
Menurut Halim, pemberi suap atau sogokan berdasarkan Pasal 5 (1) dipidana dengan pidana penjara paling singkat 1 (satu) tahun dan paling lama 5 (lima) tahun dan atau pidana denda paling sedikit Rp 50.000.000,00 (lima puluh juta rupiah) dan paling banyak Rp 250.000.000,00 (dua ratus lima puluh juta rupiah) setiap orang yang: a. memberi atau menjanjikan sesuatu kepada pegawai negeri atau penyelenggara negara dengan maksud supaya pegawai negeri atau penyelenggara negara tersebut berbuat atau tidak berbuat sesuatu dalam jabatannya, yang bertentangan dengan kewajibannya; atau b. memberi sesuatu kepada pegawai negeri atau penyelenggara negara karena atau berhubungan dengan sesuatu yang bertentangan dengan kewajiban, dilakukan atau tidak dilakukan dalam jabatannya.
Sedangkan pada ayat (2) dinyatakan bahwa bagi pegawai negeri atau penyelenggara negara yang menerima pemberian atau janji sebagaimana dimaksud dalam ayat (1) huruf a atau huruf b, dipidana dengan pidana yang sama sebagaimana dimaksud dalam ayat (1).
Halim menambahkan, setidaknya sejumlah modus korupsi di lingkungan PT, diantaranya dalam bentuk: kickback dalam kontrak suplai konstruksi; menahan atau memperlambat persetujuan dan tandatangan yang diperlukan untuk memeras suap (hadiah, jasa, dan pembayaran segera); mengarahkan agar pembangunan dan pengadaan barang dikerjakan oleh dirinya sendiri, keluarga, dan temannya; mengharuskan pembayaran untuk pelayanan-pelayanan yang seharusnya diberikan gratis; beban biaya yang illegal; pembelokan pemakaian uang sumbangan masyarakat; korupsi dalam pengadaan barang dan penerimaan mahasiswa jalur mandiri; pembelian tanah lahan kampus yang berbeda antara harga sebenarnya dengan yang dibayarkan serta permainan pengurusan surat sertifikat tanah; Khusus dalam masalah uang pangkal penerimaan mahasiswa baru, terjadi adanya kesepakatan antara pihak pemberi dan penerima untuk deal jumlah sumbangan.
“Yang membuat hati kita miris adalah pelaku utamanya melibatkan profesor dan doktor. Ini artinya korupsi bukan lagi milik politisi, kepala daerah, birokrasi, dan pihak swasta, tetapi terjadi disemua lembaga dan profesi dengan jenjang akademik tertinggi. Ini sudah sangat membahayakan bila PT telah menjadi bagian dari korupsi itu sendiri,” tegas Halim.
Perguruan tinggi menyumbang sebanyak 86 persen koruptor di Indonesia, kata Halim sambil mengutip pendapat Wakil Ketua KPK, Nurul Ghufron beberapa waktu lalu.
“Perguruan Tinggi merupakan miniatur dari ketaatan dan penegakan hukum dalam masyarakat. Masyarakat kampus, khususnya pimpinan, dosen dan mahasiswa sebagai institusi keilmuan dan agent of moral harus berada di terdepan mengusung dan berani mengatakan kebenaran dan menyampaikan kritikan bila dalam kehidupan sehari-hari ada yang melanggar prinsip-prinsip University Governance (GUG),” tegas Halim
Kampus sebagai miniatur negara harus bisa menginternalisasikan prinsip-prinsip moral dalam mengelola intitusi pendidikan bukan hanya sekadar klise. “Jangan hanya disibukkan dengan simbol-simbol semata dan mengabaikan yang substantif,” ungkap Halim.
“Seharusnya perguruan tinggi dan lingkungan kampus ditandai dengan taat hukum, akuntabel, dan bersih dari anasis-anasir tindakan korupsi, kolusi dan nepotisme yang merugikan nama baik PT. Harus ada komitmen menjalankan seluruh proses bisnis yang bermoral dan beretika serta terhindar dari praktik korupsi dan nepotisme di dalam kampus,” harap Halim.
“Jika di perguruan tinggi saja sudah lumrah terjadi korupsi, maka benteng moral dan hukum tersebut berarti sudah ambruk. Ini adalah bencana besar dalam kehidupan berbangsa dan bernegara,” tegasnya.
Bagi Halim semua itu harus dimulai dari menciptakan lingkungan yang kondusif dan transparan dalam berbagai kegiatan dan kebijakan. “Kita didik mahasiswa kita dengan membuka peran dan partisipasi yang seluas-luasnya, mulai dari tahap perencanaan kegiatan, implementasi program, evaluasi dan pengawasan serta melibatkan partisipasi publik yang lebih luas, khususnya dosen, mahasiswa dan tenaga kependidikan, dan alumni,” ungkap Halim.
